Social Roots
Arraigo social is the most common type among the irregular foreign population. After
exactly 3 years of continuous residence in Spain, a foreigner can regularize his or her situation. There are also two other types of arraigo:
labor arraigo and
family arraigo. Below are the requirements for the three types of arraigo.
Requirements for Social Rooting
To apply for
social roots, it is necessary to
prove 3 years of continuous residence in Spain and comply with one of the following requirements:
- Family ties in the country.
- Favorable social report issued by the City Hall or the Autonomous Community, known as social insertion report.
In addition, it is required:
- No criminal or police record (legalized or apostilled certificate from the country of origin is required).
- Have an employment contract (it is recommended to obtain one, although in some cases it may be waived if sufficient means of support can be demonstrated).

Labor Roots
The
labor roots require proof of at least
6 months of irregular work, which can be demonstrated by means of documents issued by public entities, mainly the census. In addition, it is necessary to have an administrative resolution from the Labor Inspectorate or a judicial resolution confirming the existence of the labor relationship.
Family Roots
Family roots require proof of the existence of a family relationship with a child born in Spain.
Rooting Application Procedure
The
authorization for temporary residence due to “arraigo” must be submitted at the immigration office.

Necessary Documentation for the Application of Arraigo
- Application Form EX-10.
- Valid passport or travel document, valid for at least four months.
- Employment contract signed by the employee and the employer, with a minimum duration of one year.
- Proof of a continuous stay of 3 years in Spain.
- Company documentation, self-employed, taxes, VAT, IRPF and corporations.

Types of Violations
Minor Infractions
Minor infractions include omissions in mandatory communications, such as changes in nationality, marital status, domicile or employment circumstances. These infractions are punishable by a
fine of 500 euros.
Serious Violations
Serious violations include:
- Irregular stay in Spain.
- Work without residence and work authorization.
- Falseness in the communication of data to the Ministry of the Interior.
- Participation in activities contrary to public order.
These violations are punishable by a fine of 301 to 6,000 euros, and may be replaced by expulsion from the country.
Very Serious Violations
Very serious violations include:
- Activities contrary to the external security of the State.
- Hiring of workers without permits.
- Inducing illegal immigration.
These infractions are punishable by a fine of 6,001 to 60,000 euros, and in some cases, by expulsion from the national territory.
